Please read these Terms of Service carefully before using Maya's Magic School Bus. By creating an account or using our platform, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using the Maya's Magic School Bus platform ("Platform," "App," or "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Platform.

We may update these Terms at any time by posting a revised version with a new "Last Updated" date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

2. About the Platform

Maya's Magic School Bus is a private childcare and pet-sitting booking platform based in Atlanta, Georgia. The Platform connects families ("Parents") with trusted caregivers ("Sitters") for professional childcare and related services, which may be delivered by independent contractors. Services include:

Maya's Magic School Bus operates as an invitation-only platform. All users must be approved by the platform administrator before gaining access. We reserve the right to modify or discontinue any service at any time.

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

We reserve the right to suspend or terminate accounts that violate these Terms or are used for unauthorized purposes.

5. Booking and Services

Booking Requests

Parents may submit booking requests through the Platform by providing accurate information. Bookings are not confirmed until the platform administrator has reviewed and approved the request and assigned a sitter. We reserve the right to accept or decline any booking at our discretion.

Minimum Session Length

Most bookings require a minimum of 2–3 hours depending on location, service type, and time of day. Minimum session requirements will be communicated at the time of booking confirmation.

Sitter Assignment

The platform administrator assigns sitters based on availability, qualifications, and fit. Parents may communicate preferences but do not have the right to demand a specific sitter.

Service Accuracy

Sitters are responsible for being on time and providing the care described in the booking. Parents are responsible for providing accurate information about all care needs, including medical conditions, allergies, and emergency contacts.

Illness Policy

Services will not proceed if a child is displaying symptoms of contagious illness, including but not limited to fever, vomiting, or active infection. Parents are expected to notify the administrator promptly if a child becomes ill before a scheduled booking.

Home Safety

Parents must ensure the care environment is safe for both the child and the sitter. This includes securing hazardous items, disclosing the presence of pets, and providing the sitter with appropriate access to the home. Maya's Magic School Bus is not liable for incidents arising from an unsafe home environment.

6. Rates & Payments

All payments are processed externally through Square or Venmo. Maya's Magic School Bus does not process or store payment card information.

Rates

Service rates are set by the platform administrator and communicated at the time of booking. Rates may vary based on the number of children, duration, time of day, travel distance, and other factors.

Holiday Pricing

Special rates may apply during major holidays and high-demand periods, including but not limited to New Year's, Easter, Independence Day, Thanksgiving, Christmas, and other peak weekends. Holiday rates will be communicated in advance.

Overtime

Additional time beyond the booked duration is billed in 15-minute increments at the applicable hourly rate. Late pickups are charged at the standard hourly rate plus any applicable late fees.

Outstanding Balances

Outstanding balances may result in suspension of future bookings until the balance is resolved. Payment is expected promptly after services are rendered unless otherwise arranged in writing with the administrator.

Platform Fees

Sitters are subject to a monthly platform fee as determined by the administrator. Fee status (pending, paid, or waived) is tracked within the Platform.

Cancellations must be communicated through the Platform or by contacting the administrator directly. Refunds beyond the schedule above are issued only at the administrator's discretion.

Repeated last-minute cancellations may result in booking restrictions or account suspension.

9. Emergency Authority & Child Safety

Parents are strongly encouraged to complete their Emergency Information profile, including emergency contacts, medical needs, and special instructions for their children. This information is confidential and shared only with the assigned sitter and the platform administrator.

In the event of a medical emergency, sitters are authorized to contact emergency services (911) and will notify parents immediately. By providing emergency information, you authorize the assigned sitter to act on it in your child's best interest.

10. Communication Consent

By using the Platform, you consent to receive scheduling updates, booking confirmations, policy notices, and emergency communications via email, text message, or phone call. Standard messaging rates may apply.

11. Independent Contractors

Sitters using the Platform operate as independent contractors and are not employees of Maya's Magic School Bus. The Platform facilitates connections between families and sitters but does not employ sitters directly and is not a licensed childcare agency. Sitters bear responsibility for their own conduct, insurance, and tax obligations.

12. Indemnification

Parents agree to indemnify and hold harmless Maya's Magic School Bus, its administrators, and sitters from any claims, losses, or damages arising from: inaccurate information provided during booking; an unsafe home environment; or failure to disclose relevant medical or safety information about your children. Maya's Magic School Bus is not liable for delays, cancellations, or service interruptions caused by events outside our reasonable control.

13. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service, that all booking requests will be fulfilled, or the conduct of any sitter beyond our vetting process. Clients assume the inherent risks of childcare and pet-sitting services.

14. Limitation of Liability

To the fullest extent permitted by law, Maya's Magic School Bus and its administrators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform or services arranged through it, except in cases of proven negligence. Our total liability for any claim shall not exceed the amount paid for the specific booking in dispute.

15. Termination

We reserve the right to suspend or permanently terminate your access to the Platform at any time for any reason, including violation of these Terms. You may deactivate your account by contacting us at mayasmagicschoolbus@gmail.com.

16. Governing Law

These Terms are governed by the laws of the State of Georgia, United States. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of Georgia.
